These Terms of Service (“Terms”) govern your use of the hosting services provided by VastyHost (“we,” “our,” or “us”). By registering for, purchasing, or using our services through WHMCS or directly via our website, you (“you,” “your,” “Customer”) agree to be bound by these Terms.
If you do not agree, you may not use our services.
1. Eligibility & Account Setup
1.1. To register for an account, you must be at least 18 years old or the age of majority in your jurisdiction.
1.2. You agree to provide accurate, complete, and up-to-date information when creating your WHMCS client account.
1.3. You are responsible for maintaining the confidentiality of your login credentials. Any activity carried out under your account is deemed authorized by you.
2. Services Provided
2.1. VastyHost provides web hosting, domain registration, VPS, and dedicated server solutions.
2.2. The scope, limitations, and features of each service are described on our website and within the WHMCS platform.
2.3. Services are provisioned upon successful payment and verification.
3. Billing & Payment
3.1. All services are billed in advance according to the billing cycle selected during checkout in WHMCS.
3.2. Accepted payment methods include credit/debit cards, PayPal, and other methods displayed at checkout.
3.3. Payments are non-refundable unless otherwise specified under our Refund Policy.
3.4. Invoices are generated automatically in WHMCS. Unpaid invoices may result in suspension or termination of services.
3.5. Customers are responsible for all applicable taxes, VAT, or similar charges imposed by law.
4. Refunds & Money-Back Guarantee
4.1. Shared hosting and VPS services may include a money-back guarantee period (details available on our website).
4.2. Dedicated servers, domain registrations, and SSL certificates are non-refundable.
4.3. Refunds, if granted, will be processed via the original payment method.
5. Acceptable Use Policy (AUP)
5.1. Customers must not use VastyHost services for:

Hosting or distributing malware, viruses, or harmful code.

Sending spam, phishing, or unsolicited bulk emails.

Hosting illegal content (including copyrighted materials without authorization, child exploitation content, or material prohibited by EU law).

Running abusive scripts or processes that disrupt server performance.
5.2. We reserve the right to suspend or terminate services without notice for violations of this policy.
6. Service Level Agreement (SLA)
6.1. VastyHost guarantees 99.9% uptime per calendar month, excluding scheduled maintenance and circumstances beyond our control (force majeure).
6.2. SLA credits may be requested if uptime falls below this threshold, subject to review. SLA credits are applied as service credits only and are not refundable in cash.
7. Data Protection & Privacy
7.1. VastyHost is committed to GDPR compliance. Our processing of personal data is outlined in our Privacy Policy.
7.2. Customers remain the data controllers of the information they host on our servers; VastyHost acts as a data processor.
7.3. Customers are responsible for ensuring their content complies with applicable data protection laws.
8. Backups & Data Responsibility
8.1. While VastyHost may offer automated backups, customers are solely responsible for maintaining their own backups.
8.2. VastyHost is not liable for data loss resulting from hardware failure, account suspension, or misuse of services.
9. Domain Registration & Management
9.1. Domains registered through VastyHost are subject to ICANN and registry policies.
9.2. Failure to renew domains before expiration may result in loss of ownership.
9.3. VastyHost is not responsible for domain disputes, trademark issues, or domain recovery.
10. Suspension & Termination
10.1. Accounts may be suspended or terminated for:

Non-payment of invoices.

Breach of these Terms or our Acceptable Use Policy.

Legal or regulatory orders.
10.2. Upon termination, all data, websites, and configurations may be permanently deleted.
11. Limitation of Liability
11.1. To the maximum extent permitted by law, VastyHost shall not be liable for:

Indirect, incidental, or consequential damages.

Loss of data, revenue, or business opportunities.

Downtime beyond the scope of our SLA.
11.2. VastyHost’s total liability shall not exceed the fees paid by the customer during the preceding 12 months.
12. Indemnification
You agree to indemnify and hold harmless VastyHost, its employees, and partners from any claims, damages, or expenses arising out of your use of our services or violation of these Terms.
13. Modifications
VastyHost reserves the right to update these Terms at any time. Updates will be posted on our website and within the WHMCS client area. Continued use of services constitutes acceptance of revised Terms.
14. Governing Law & Jurisdiction
14.1. These Terms are governed by the laws of the European Union and the specific jurisdiction of Bulgaria.
14.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of that country.
